SparkNet Sues Clear Channel

SPARKNET COMMUNICATIONS, OWNER OF THE JACK FM TRADEMARK AND RADIO FORMAT, SUES CLEAR CHANNEL COMMUNICATIONS FOR CYBERSQUATTING AND TRADEMARK INFRINGEMENT

SAN DIEGO, CALIFORNIA -- (August 18, 2005) -- SparkNet Communications, L.P. - the owner of the JACK FM and PLAYING WHAT WE WANT® trademarks - filed a lawsuit today in San Diego federal district court against the largest radio broadcasting company in world.

The suit alleges Clear Channel is a cybersquatter and trademark infringer.

SparkNet’s JACK FM and PLAYING WHAT WE WANT branded radio product is the most successful radio format launched in the past 20 years. Since 2001, the JACK FM format has been available on the Internet, and it is now on terrestrial radio in almost 20 of the largest U.S. cities.

Clear Channel’s KMYI radio station in San Diego is using the Internet address http://www.JackFMSanDiego.com, but is not an authentic Jack FM station. Clear Channel’s WLTY station in South Carolina is using the trademark PLAYING WHATEVER WE WANT, which SparkNet alleges is an infringement of its PLAYING WHAT WE WANT mark.

"Clear Channel seems to believe its market dominance allows it to steal our valuable trademarks," said Garry Wall, SparkNet’s co-president. "But, SparkNet will defend its intellectual property and ensure that neither Clear Channel nor any other competitor trades off SparkNet’s goodwill and the success of the JACK FM branded format."

"This is a classic case of trademark infringement and cybersquatting," Derek Newman, SparkNet’s lawyer stated. "SparkNet has been innovative in both establishing its distinctive brands, and in creating a unique and popular radio product. As the suit alleges, Clear Channel is now unlawfully using SparkNet’s trademarks in an effort to improve its own radio stations. As a result, consumers are confused into believing SparkNet somehow endorses or is responsible for Clear Channel’s competing products."

A hearing on the matter has not yet been set.
